Terms of service

These terms govern your use of thesweetstruck.com, our retail and wholesale orders, and any related services we operate at our subdomains. TheSweetsTruck is a California-based importer and distributor of Swedish and Scandinavian candy serving the United States, Canada, and Sweden. By using the site or placing an order, you agree to these terms; if you don't agree, please don't use the service.

1. Acceptance and changes

By creating an account, placing an order, or otherwise using thesweetstruck.com, you agree to these terms and to our Privacy policy. If you're agreeing on behalf of a company (any wholesale account), you represent that you have authority to bind that company to these terms.

We may update these terms as our service and the law evolve. Material changes will be posted prominently on the site at least 14 days before they take effect, and registered customers will receive an email notice. Continuing to use the service after the effective date constitutes acceptance of the updated terms.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction, if higher) to place an order or create an account. Wholesale accounts are for legitimate businesses with a valid resale or business registration. We may decline or close any account at our discretion, including for failure to meet eligibility criteria.

3. Your account

You are responsible for keeping your account credentials secure and for everything that happens under your account. Notify us immediately at hello@thesweetstruck.com if you suspect unauthorized access. We're not liable for losses from credentials shared or compromised through no fault of ours.

You agree to provide accurate, current, and complete information at signup, and to keep it current. Inaccurate business information on a wholesale application is grounds for declining or revoking the account.

4. Products, pricing, and orders

  • Catalog. Product names, descriptions, photos, weights, and ingredient information are provided in good faith and sourced from the manufacturers we distribute. Manufacturer formulations and packaging change without notice. Always read the printed package label before consumption.
  • Pricing. Retail prices are shown in your market's currency (USD, CAD, or SEK) and exclude taxes, duties, and shipping unless explicitly stated. Wholesale prices are gated behind an approved wholesale account and rendered as tier prices in the same per-market currency. We reserve the right to correct pricing errors, including after an order is placed; if a correction would materially change the order total, we'll contact you to confirm before processing.
  • Order acceptance. An order is an offer to purchase. We confirm acceptance by sending an order confirmation email. We may decline orders for any reason, including stock issues, payment problems, suspected fraud, or shipping restrictions.
  • Availability. Inventory is finite. If an item becomes unavailable after order placement, we will refund the line item or offer a substitute at our discretion.
  • Payment. Payments are processed by Stripe under their own terms and our Privacy policy. By submitting a payment, you authorize Stripe and us to charge the indicated amount to your selected payment method.

5. Wholesale terms (B2B)

Wholesale customers are subject to additional terms beyond the retail terms:

  • Minimum order quantity (MOQ). First wholesale order must be at least $400 in product subtotal (excluding shipping, taxes, and duties). Reorders may have lower MOQ at our discretion.
  • Payment terms. First order is prepaid (credit card or wire). After a first order has cleared, qualified accounts may apply for Net-30 terms. Net-30 is granted at our discretion based on the information you provide and external credit information; approval is not guaranteed.
  • Late payment. Invoices unpaid after the Net-30 due date may incur a late fee of 1.5% per month (or the maximum allowed by law, whichever is lower) and may result in your account being moved back to prepaid terms.
  • Tier pricing. Approved wholesale accounts are assigned a pricing tier (B2B Tier 1, 2, or 3). Tier prices appear in your account portal after login. Tier changes are at our discretion based on order history and category fit; we'll notify you in advance of any tier change that would affect future orders.
  • Resale, packaging, and branding. You may resell our products in their original sealed packaging. You may not relabel, repackage, or alter our products in any way that would obscure manufacturer information, allergen statements, or expiration dates. You may not represent our products as your own brand or as a product of any other brand. We grant a limited, revocable license to use brand product photography from media.thesweetstruck.com for the purpose of selling our products through your storefront; the license terminates if you stop carrying the product or breach these terms.
  • Title and risk of loss. Title and risk of loss pass to you upon delivery to the carrier at our warehouse, unless your order is shipped DDP (delivered duty paid), in which case title passes upon clearing customs in the destination country.
  • Pricing confidentiality. Wholesale pricing is confidential. You agree not to disclose negotiated tier prices to third parties outside your business.

6. Shipping, delivery, and customs

  • Origin. Orders ship from our warehouse in California.
  • Delivery windows.
    • United States: typically 2 business days in transit after dispatch (we typically dispatch within 1 business day of order confirmation).
    • Canada: typically 3 to 5 business days DDP (delivered duty paid). We pre-pay duties and brokerage so there are no surprise fees at delivery.
    • Sweden: lead times shown at checkout for each available shipping method.
  • Shipping costs and taxes. Shown at checkout. Where local law requires us to collect sales tax, GST/HST, or VAT, we add it to the order total.
  • Customs and import. US and Canadian orders include customs clearance. Other international shipments may incur duties or taxes payable by the recipient, depending on local law.
  • Hot-weather risk. Chocolate and certain heat-sensitive items may melt or bloom in transit during warm months. We use insulated packaging where appropriate but cannot guarantee a heat-free delivery. We accept reasonable claims for shipments arriving visibly heat-damaged; cosmetic bloom on chocolate that remains safe to consume is not refundable.
  • Address accuracy. You're responsible for providing an accurate shipping address. Reshipping due to an incorrect or undeliverable address is at your cost.
  • Carrier delays. Stated delivery windows are estimates based on carrier service. Carrier delays, weather, customs holds, and other events outside our control may extend delivery. These do not entitle you to a refund except as required by law.

7. Returns, refunds, and order issues

The short version. Wrong, damaged, or missing items: we make it right at our cost. Change of mind on sealed, ambient-shelf-stable candy: returns accepted within 14 days at your shipping cost. Open or perishable items: no returns for food-safety reasons.
  • Damaged or defective on arrival. Email hello@thesweetstruck.com within 7 days of delivery with order number and photos. We'll arrange a replacement, store credit, or refund.
  • Wrong item shipped. Same procedure as damaged. We pay return shipping (or you can keep the wrong item if returning isn't practical and we ship the correct one).
  • Change of mind, retail. Returns of sealed, unopened, ambient-shelf-stable candy accepted within 14 days of delivery. You pay return shipping. Refunds are issued to the original payment method within 7 business days of receiving the returned items in resaleable condition. Refrigerated, frozen, or expiration-dated items within 30 days of expiration are not eligible for change-of-mind returns.
  • Change of mind, wholesale. Wholesale orders are not returnable except for damage or defect. Unsold inventory at the wholesale tier is not eligible for return or credit unless we agree in writing in advance.
  • Refused or undeliverable shipments. If a shipment is refused by the recipient or returned to us as undeliverable for reasons within your control, the original shipping fee is non-refundable and we deduct return-shipping costs from any refund.
  • Cancellation. Orders can be cancelled before they ship by emailing hello@thesweetstruck.com. Once a shipment label is printed, cancellation is no longer possible; treat as a return on receipt.

EU and Swedish consumers have additional rights under EU consumer law, including a 14-day right of withdrawal for distance-sold consumer goods. See section 18.

8. Allergens and food safety

Always read the printed package label. Allergen and ingredient information shown on product pages is provided in good faith from the manufacturer, but manufacturers may change recipes, suppliers, and shared-line processes without notice. The printed label that arrives with the product is authoritative.

Our catalog contains products that may contain milk, eggs, soy, wheat, gluten, peanuts, tree nuts, sesame, and other common allergens, including products manufactured on shared lines with these allergens. We are not the manufacturer of the products we distribute; we cannot certify the absence of cross-contamination.

If you have a severe allergy, please consult the printed label and contact the manufacturer directly before consuming. We will refund or replace any product you cannot consume because the printed label conflicts with the website description, as long as the product is returned (or photographed for proof) within 30 days of delivery.

9. Acceptable use

You agree not to:

  • Use the service for any unlawful purpose or to violate any applicable law or regulation (including export controls, food import rules, and tax law).
  • Scrape, harvest, or republish our catalog, pricing, brand information, or product photography for use outside the resale license described in section 5.
  • Interfere with, disrupt, or attempt to gain unauthorized access to the service, the underlying servers, or other customers' accounts.
  • Submit false, misleading, or fraudulent information in an order, wholesale application, or account profile.
  • Use the service to send unsolicited bulk communications.
  • Reverse-engineer, decompile, or attempt to extract the source code of any proprietary software running the service.

We may suspend or terminate access for violation of these rules.

10. Intellectual property

The TheSweetsTruck name, logo, site design, original photography, product descriptions written by us, and other content we author are owned by TheSweetsTruck and protected by US, EU, and international copyright and trademark law. Brand names, manufacturer logos, and original manufacturer photography belong to the respective brands and are used to describe the products we distribute under fair-use principles.

The limited license described in section 5 covers approved wholesale accounts for the purpose of reselling our products. No other use is granted.

11. User content

If you submit reviews, ratings, photos, social mentions, testimonials, or other content to us or through our channels, you grant TheSweetsTruck a worldwide, royalty-free, perpetual, non-exclusive license to use, reproduce, adapt, and display that content for our marketing and operations. You confirm that the content is yours to submit and that it does not violate any third party's rights. We may remove user content at our discretion (for legal, brand, or quality reasons).

12. Third-party services and links

The service relies on third-party providers (payment, shipping, email, hosting, analytics) and may link to third-party sites. We are not responsible for third-party content, terms, or practices. Your interactions with third parties are governed by their own terms and policies. See our Privacy policy for the list of processors and what data each receives.

13. Disclaimers

To the maximum extent permitted by law, the service and all products are provided “as is” and “as available”. We disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. Nothing in these terms excludes any warranty or liability that cannot be excluded by law (including non-excludable consumer warranties in California, Quebec, the EU, and Sweden).

14. Limitation of liability

To the maximum extent permitted by law, TheSweetsTruck, its officers, employees, and contractors are not liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or related to your use of the service.

Our aggregate liability for any claim arising out of or related to these terms or the service is limited to the greater of (a) the amount you paid us in the 12 months preceding the event giving rise to the claim, or (b) USD $100.

Some jurisdictions don't allow the exclusion or limitation of certain damages, so the above limitations may not apply to you. Nothing in this section limits liability for fraud, willful misconduct, gross negligence, or any liability that cannot be limited by law.

15. Indemnification

You agree to defend, indemnify, and hold harmless TheSweetsTruck and its officers, employees, and contractors from and against any claims, damages, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of (a) your breach of these terms, (b) your misuse of the service, (c) your violation of any law or third-party rights, or (d) for wholesale accounts, your resale of our products in a manner inconsistent with section 5 (including any relabeling, repackaging, or misrepresentation).

16. Termination

You may close your account at any time by emailing hello@thesweetstruck.com. We may suspend or close your account at our discretion, with or without notice, for breach of these terms, fraud, abuse, non-payment, or extended inactivity. Sections that by their nature should survive termination (intellectual property, disclaimers, limitation of liability, indemnification, governing law, and these survival terms) will survive.

17. Governing law and disputes

These terms and any dispute arising out of them are governed by the laws of the State of California, USA, without regard to its conflict-of-law principles, except where a non-waivable consumer-protection law of your home jurisdiction applies (see section 18).

For US-resident customers (B2C and B2B): any dispute will be resolved in the state or federal courts located in Los Angeles County, California, and both parties consent to the exclusive jurisdiction of those courts. You agree to waive any right to a jury trial and to participate in a class action, to the extent permitted by law.

Before filing a formal claim, you agree to attempt to resolve the dispute informally by contacting us at hello@thesweetstruck.com with a detailed description of the issue. We'll do the same in reverse. We both agree to attempt good-faith resolution within 30 days before escalating.

18. EU, Sweden, and Canada consumer rights

Nothing in these terms is intended to limit your non-waivable consumer rights under the law of your home jurisdiction, including:

  • EU and Sweden: Under the EU Consumer Rights Directive and the Swedish Distance Contracts Act (Distansavtalslagen), consumers who buy goods online have a 14-day right of withdrawal from the day of delivery, without giving a reason, subject to specific exclusions (sealed goods that have been unsealed, perishables, and certain other categories). EU consumers may also use the EU Online Dispute Resolution platform.
  • Canada: Provincial consumer-protection laws apply to your purchase, including Quebec's Consumer Protection Act for Quebec residents.
  • California: California Civil Code §1789.3 provides specific rights to California consumers; you may contact the Complaint Assistance Unit of the Division of Consumer Services of the California Department of Consumer Affairs in writing at 1625 N. Market Blvd., Suite N 112, Sacramento, CA 95834, or by telephone at (800) 952-5210.
